Where a mineral or waste management site is operated under contract, the terms of that contact are critical to the careful management and policing of operations on the ground in what are usually long term relationships.
Our services include inspecting and managing properties to ensure operators are working in accordance with their contractual, legal and planning requirements at all times. We also audit and calculate royalty payments and review rents and royalties in line with lease agreements whether by index or through open market determination. Where necessary we can act as Expert Witness in respect of dispute resolution.
Our Chartered Mineral Surveyors negotiate new mineral and waste management leases, licences, sales and option agreements on behalf of both landowners and mineral operators and we provide advice and guidance to both in respect of all aspects of such transactions. This area of practice recognises that all mineral sites and client needs can differ and we do not approach such contracts using ‘off the peg’ documents, but look to build workable solutions to meet the needs of the client.
We also have many years experience in advising on severed mineral rights and manorial titled estates. As we understand the importance of keeping abreast with the pressures facing farming and estate management businesses, we are proud members of the Country Landowners Association.
As we appreciate how ownership drivers can differ, we offer a bespoke minerals estates management service to suit the client ranging from more informal ad-hoc reviews of operations though to full management instructions taking responsibility for all aspects of monitoring a mineral or waste management operation throughout its life.
